Form I-9 Remote Document Review Flexibility Ending

COVID-19 temporary flexibilities for Form I-9 will end on July 31, 2023. U. S. Immigration and Customs Enforcement (ICE) recently announced that employers must complete in-person physical document inspections for employees whose documents were inspected remotely during the temporary flexibilities by August 30, 2023. As a refresher, ICE officials previously announced that they would permit remote review of new hire I-9 documentation for those who worked exclusively in a remote setting due to COVID-19 precautions. These new hires were temporarily exempt from the physical inspection requirements associated with the Form I-9 until the earlier of (a) when they undertook non-remote employment on a regular basis, or (b) until the extension of the flexibilities related to such requirements is terminated - effective July 31, 2023.
